Council is seeking your feedback on a request for a Right of Way easement over Prospect Estate Reserve Carpark.

Privately owned land on the north western corner of the Prospect and Regency Roads intersection adjacent Prospect Estate Reserve, is being developed by the landowners.

Due to the site being located near a busy intersection, vehicle access to the development is difficult and owners of the land have requested Council grant them a Right of Way easement through the carpark which forms part of the Prospect Estate Reserve.

If granted, the Right of Way easement would:

  • give the owners of the land development free and unrestricted right to travel over the Council owned carpark.
  • not affect the total number of carparks currently available on the site (16)
  • cause the movement and reconstruction of the existing toilet block, some gradient changes and some relocation of carparks.

Council would seek compensation by requesting owners of the land to construct a new toilet block to Council’s specification, undertake various landscaping works and reconstruct as necessary the existing carpark to meet the adjoining development and Council requirements.

Council is committed to ensure visitor access to Prospect Estate Reserve is not reduced if the Right of Way easement and subsequent redevelopment is approved.

    Owners of the land presented their proposed future development on the parcel of land adjacent Prospect Estate Reserve and requested Council grant them an easement (Right of Way) through the carpark which forms part of the Reserve.

    19 January 2021

    Council endorse the proposed Right of Way over Prospect Estate Reserve Carpark for community consultation.

  • Stage 3 - Community Consultation

    11 February - 3 March 2021

    Consultation on the proposed Right of Way Over Prospect Estate Reserve Carpark  to inform our community of the request, determine the level of community support and invite feedback on the proposal.

  • Stage 4 – Council Meeting – Consultation Results and Recommendation for Decision

    23 March 2021

    Results of the community consultation presented and a recommendation proposed for Council endorsement, based on the results from the consultation.
